In order to obtain and retain the services of Koomohost, you (The Customer) are required to read and abide by both the Acceptable Usage Policy (AUP) and Terms of Service (TOS). Koomohost’s services may only be used for lawful purposes; engaging in activities that are illegal and/or are listed as prohibited activities in the AUP can result in the termination of your service. All decisions regarding the termination of service due to illegal activities are done at the full discretion of Koomohost.
The AUP is designed to help protect both Koomohost and its customers, as well as the Internet at large, from irresponsible and/or illegal activities. The AUP is a non-exclusive list that Koomohost reserves the right to modify at any time.
Activities Prohibited on Koomohost Hosting Service
1. Unsolicited Bulk Email
Sending unsolicited bulk email (“UBE,” “Spam”) in any form through Koomohost’s servers is strictly prohibited. UBE may also not be sent from any email address or website hosted all or in part through Koomohost. You are prohibited from utilizing any Koomohost account to solicit customers from/collect replies to messages from another Internet Service Provider where the message violates any aspect of the Koomohost AUP.
It is a violation of United States State and Federal Law to send unsolicited emails or spam, and Koomohost considers it a violation of the AUP to reference its servers in said messages. Doing so will result in the termination of your services, and Koomohost reserves the right to charge the offender one dollar (US$1.00) for each email recipient of any aforementioned violations.
2. Mass Mailings
Mass mailings, which include scripts used to distribute mass mailings and/or any other type of high volume messages, are a violation of the AUP. You are prohibited from purchasing lists from 3rd parties and using Koomohosted domains or referencing any Koomohost account.
3. Internet Abuse
It is forbidden to:
- Use a non-existing email return address when sending any type of solicitous commercial email
- Mail-bombing (sending multiple messages with little to no variation of content)
- Trolling (Posting outrageous messages on any type of forum in order to generate a large number of responses
- Subscribing another individual to a mailing list without his/her consent
- Attempting to enter a restricted, secured computer system without prior consent from the owner
- Koomohost reserves the right to determine what is and what is not Internet abuse on its servers.
4. Advertising
Advertising and/or transmitting, or making available any type of software, program, product, or service designed to violate this or any other Internet Service Provider’s AUP. Examples include, but are not limited to, facilitating the means of distributing unsolicited bulk email, mail-bombing, flooding, initiation of pinging, and/or denial of service attacks.
5. Spam Sales
Reselling service to, or operating an account on behalf of any entity listed on the Spamhaus Register of Known Spam Operations (ROKSO)
6. Pornography
Koomohost does not host adult (pornographic) websites and the customer further agrees that Koomohost will not be held responsible for any legal action taken against you should you choose to ignore this rule.
7. Federal and/or State Laws
No website that breaks US State and/or Federal laws will be hosted by Koomohost.
8. Piracy
The unauthorized distribution and/or copying of copyright material (warez, ROMs, cracks, MP3s, etc) This also includes copyright material such as images, videos, and/or any intellectual property of another individual and/or company, which may not be placed on your website without the owner’s express written consent.
9. Phishing
Any website designed to collect personal information via fraud or misleading tactics is forbidden.
10. Download Sites
Koomohost does not host websites designed primarily to distribute files such as audio, video, images, and/or any other file type intended for distribution. Koomohost does not allow using your disc storage quota for file sharing and backup.
11. URL Obfuscation
Koomohost does not allow the use of scripts designed to shorten and/or obfuscate URLs, due to the potential for abuse by spammers.
12. Cracking/Hacking
Unauthorized attempts to gain entry and/or alter/cause damage to a computer, network, and/or software, or instructing others on how to do so.
13. Attempting to Get Free Service
Attempting to obtain a service, using Koomohost’s servers, by any means with the intent to avoid payment for said service.
14. Unauthorized Access
Unauthorized access, or attempted access, to obtain information regarding other Koomohost customers, or the alteration and/or destruction of customer information.
15. Harrassment
Engaging in the activities meant to harass others, either on the Koomohost network or any other Internet Service Provider. This includes, but is not limited to, slander, defamation, libel, and the posting of private information without the owner’s consent.
16. Denial of Service
The use of Koomohost’s services to interfere with the services provided to other Koomohost customers or those of any other Internet Service Provider.
17. Misuse of System Resources
- The utilization and installation of scripts or other programs onto Koomohost servers that:
- Consume excessive CPU time or storage space
- Allowing mail servers
- Provide mail forwarding capabilities
- POP accounts
- File Managers
- Autoresponders
- Resale/outsource access to scripts installed on Koomohost servers
18. Script Sharing
Script sharing with other servers in not allowed, and any script determined to cause significant slowdown to Koomohost’s servers or endanger network integrity will be removed.
19. IRC/Chat Rooms
IRC software/bots, and/or Eggdrop bots are not allowed. Customer installed chat room scripts and programs are forbidden from being installed on Koomohost servers.
20. Webcams
Webcams consume large amounts of bandwidth and are not allowed on Koomohost.
21. File Systems
File systems, system binaries, virtual servers, and/or shell emulators are prohibited.
22. Banner Ads
Banner ad services to outside websites is forbidden, although ads on your own website are allowed.
23. Dating Sites
Scripts designed for dating/personal sites that send out anonymous emails are forbidden.
24. Script Stability
You are responsible for the maintenance and upkeep of all scripts installed on your website. All scripts/code must be kept up-to-date, and Koomohost reserves the right to update your scripts/code in the event of a potential security/stability risk.
Responsibility for Customer’s Users
You are responsible for all activities of your website users. By accepting the AUP, you agree to ensure that all customers, representatives and end-users adhere to the guidelines set forth in the AUP and TOS. Any complains will result in an investigation and possible action by Koomohost.
Koomohost reserves the right to, at its discretion, take any and all necessary action, up to and including the termination of your services for any violation occurring on your website by any customer, representative, and/or end-user. All Illegal activities will be reported to the proper authorities.
